Policies and Precedents

Our subject matter experts have provided updates to some of our templates. A policy regarding Artificial Intelligence is also now available, ensuring that you’re prepared and compliant with the use of this evolving technology.

Client Care and File Management

  • Artificial Intelligence Policy v1 (New)

    • The aim of the policy is to set out acceptable and prohibited uses of AI, ensure transparency, fairness, and accountability, safeguard client confidentiality, and provide a governance structure for AI tools. It includes a glossary of AI-related terms and a reference table in the appendix which sets out the acceptable use of internal and external tools – intended to be used by staff as a quick-reference guide.

  • Terms of Business v2.9

    • Has been updated to add in new sections on unclaimed client funds and the use of artificial intelligence (AI) (to accompany the release of our template AI Policy). Firms are increasingly using AI tools, and the new section acts as a prompt to encourage those that do to be transparent with clients on areas such as which tools they are using and for what purposes. The complaints section has also been updated to align more with the Legal Ombudsman guidance on signposting clients to them at the point of engagement.

  • Vulnerable Clients and Safeguarding Policy v1.1

    • Has been updated to refer to recent research on consumer vulnerability commissioned by the SRA, which is in favour of moving from a risk-based to a universal practice approach – it is important that firms bear this in mind should the SRA decide to adopt this approach to consumer vulnerability in the future. Information Technology and Data Protection.

Legal and Regulatory Compliance

  • Anti-Bribery Policy v2.4

    • Has been updated on a light touch basis to make some of the wording more concise.

  • Anti-Facilitating Tax Evasion Policy v2.1

    • Has been updated to include reference to deliberately submitting false claims to HMRC as an example of tax evasion and to add in a recommendation to warn conveyancing clients about the risk of unscrupulous organisations contacting them after purchasing a property encouraging them to make a false claim.

  • Conflicts Policy v3.1

    • Has been updated on a light touch basis to enhance and streamline the content where relevant. The section on own interest conflicts has been updated to merge all content on this topic into one section for ease of reference.

  • Whistleblowing Policy v2.2

    • The content has been updated across various sections to enhance clarity and streamline procedures, particularly around internal reporting, to make them easier for staff to follow.
